Appearance of Election Impropriety

An appearance of election impropriety occurs when reasonable minds, with knowledge of all the relevant circumstances disclosed by a reasonable inquiry, would conclude that the honesty, integrity, impartiality, temperament, or fitness to serve of election officials, judges, legislators, or others charged with conducting free, fair, and transparent elections is impaired. Election impropriety is an injustice against the Citizens of the United States that strikes to the core of our Constitutional Republic. Adapted from uscourts.gov

Public confidence in an election, and the persons thereby elected, is eroded by irresponsible or improper conduct by election officials, judges, legislators, or others. This includes (without limitation) willful or negligent failure to impartially and consistently implement election law, or refusal to conduct a transparent investigation of claims of election impropriety in a timely manner, and to take timely corrective action.

Refusal to allow examination of election machines and other artifacts, especially in cases where statistical anomalies or sworn witness testimony exist, or failure to allow effective monitoring of all aspects of the vote process by representatives of all parties, is prima-facie evidence of the appearance of election impropriety, and strikes to the core of public confidence in the outcome.

Transparent investigation requires a published report for each allegation that:

  1. Describes the allegation and evidence supplied.
  2. Describes the counter-evidence provided by opposing parties.
  3. Is conducted in a bipartisan manner.
  4. Balances the equal need to count all valid votes and to not count any invalid votes.
  5. Concludes whether the preponderance of evidence supports the allegation or not.
  6. If the preponderance of the evidence supports the allegation, estimates the most likely impact of the allegation on the election outcome for this incident AND the potential impact if this incident were to be extrapolated to systemic levels.
  7. In cases where the extrapolated potential impact of this incident to systemic levels might be sufficient to potentially alter the election results, a follow-up systemic investigation must be triggered. Once a "failure mode" has been identified, it is incumbent on election officials to prove that the problem is isolated, rather than systemic.
  8. Documents the reasoning supporting the above conclusions.
  9. The burden of proof of election integrity must lie on the the judges, elected officials and bureaucrats in charge of the election, and not on the citizens.
  10. Felony penalties must be levied against judges, elected officials, and bureaucrats who fail to uphold election laws.
  11. 'Proof by fiat' (nothing to see here, move along) is not acceptable. Failure to adhere to all the above criteria is more suggestive of a deliberate cover-up than proof that there is "no fire despite the smoke."

Are the above criteria too burdensome to implement? Consider the strictness of other government mandates, such as HIPPA, Sarbanes–Oxley, Generally Accepted Accounting Principles (GAAP), and banking regulations. Is the integrity of our elections any less important than these other government regulations? Should not government officials be held as accountable as all of the citizens affected by these regulations?

Consent of the governed in this Constitutional Republic is damaged by unresolved appearance of election impropriety. Without full, public, and transparent examination of all appearances of election impropriety, public confidence in the integrity of the persons elected is irreparably destroyed.

The 2020 election is over, but consent of the governed depends on full, public, and transparent examination of all alleged appearances of election impropriety. Transparent, bipartisan examination of all alleged improprieties must be done if the results of this election are to be accepted by a large portion of the voters as anything other than a "deep state" coup.

Furthermore, voter confidence in future elections will also be compromised if substantive and verifiable changes are not made to election laws to prevent reoccurrence of similar alleged or apparent improprieties in the future.

To paraphrase Reverend Martin Luther King, Jr. and Frederick Douglass: A nation dies when it refuses to stand up for that which is right. A nation dies when it refuses to stand up for justice. A nation dies when it refuses to take a stand for that which is true. A nation dies when it refuses to take a stand against election impropriety. The life of a nation is secure only while it is honest, truthful, and virtuous.

As Secretary of Housing and Urban Development Dr. Ben Carson says, "Silencing a significant number of voters and erasing history is no way to unite us; it only further divides. ... Speech should be free whether you agree or not."

The Daily Signal describes 7 ways the 2005 Carter-Baker Report could have averted problems with the 2020 election. It is time to revisit the 87 recommendations made by that bipartisan commission, and implement those recommendations before the 2022 election cycle.


Credible Evidence that Demands a Verdict

The evidence summarized by the Navaro report includes sworn testimony of credible witnesses, which still demands a full and transparent hearing and verdict.

If Rasmussen polling results are any indication, the American people believe that there is “credible evidence” of election fraud – 75% of Republican voters and 30% of Democratic voters believe there is credible evidence of vote fraud.

Court cases in this presidential election cycle have considered narrowly defined questions, in which the burden to show evidence that a single cause of error, fraud, or deceit was sufficient to change the result of the election. On the other hand, the Navaro report presents evidence that up to 6 different sources of errors, fraud, or deceit may have all contributed to an aggregate result, which evidences that the presidential election result is invalid. Without considering all 6 dimensions in an omnibus evaluation, there will forever be significant doubt that president-elect Biden won a fair election and therefore has the credibility to act as the Chief Executive Officer of the United States.

All of us are faced with two choices, both of which are lousy,” Cruz stated. “One choice is to vote against the objections. Tens of millions of Americans will see a vote against the objections as a statement that voter fraud doesn’t matter, isn’t real, shouldn’t be taken seriously. A great many of us don’t believe that. On the other hand, most if not all of us do not believe we should set aside the results of an election just because our candidate may not have prevailed. So we endeavor to look to door number three — a third option. For that I look to history, to the precedent of the 1876 election.”
